			<p><span lang="EN-US"><span class="r-es-drop-cap">A</span>ccording to a decision by the District Court of The Hague, the Royal Netherlands Marechaussee, which is the Dutch border police, can use ethnicity as a criterion for selecting citizens for checks at the border. As stated by the court, this does not constitute discrimination. </span></p>
<p><span lang="EN-US">The case was brought against the government by several human rights organizations, NGOs such as <a href="https://www.amnesty.nl/actueel/rechtbank-staat-etnisch-profileren-toe" target="_blank" rel="noopener noreferrer"><span style="background: white;">Amnesty International, Controle Alt Delete, RADAR, and PILP-NJCM, </span></a>and two citizens. These organizations were convinced that two citizens were singled out for checks by the Royal Netherlands Marechaussee officers because of the color of their skin. One of the persons, Mpanzu Bamenga was taken aside by the Marechaussee at the airport of Eindhoven in April 2018. </span></p>
<p><span lang="EN-US">Mpanzu Bamenga, who is a municipal councilor of the social liberal political party D66, had just returned from Lampedusa, Italy, where he gave a lecture about institutional racism, human rights, and how to create a world in which all human rights are secured for all humans. After the councilor’s efforts to understand why he was taken aside and filing a complaint followed by a hearing, it seemed Bamenga had been arrested for being “well dressed,” “walking fast,” and having a “non-Dutch appearance.” According to the coalition that filed the lawsuit, this is a form of discrimination that violates human rights and Dutch law. </span></p>
<p>Dagmar Oudshoorn, director of Amnesty International Netherlands, <a href="https://www.amnesty.nl/actueel/rechtbank-staat-etnisch-profileren-toe" target="_blank" rel="noopener noreferrer">stated</a> the following about the court’s decision: &#8220;According to this ruling of the court, the Royal Netherlands Marechaussee can continue with ethnic profiling. This is not only in violation of international human rights, but also of Article 1 of the Dutch Constitution.”</p>
<p>During border checks, the Marechaussee selects people based on their appearance, skin color, or ethnicity. These parameters determine whether someone, against whom there is no individual suspicion, is pulled aside. The Marechaussee also uses risk profiles that <a href="https://njcm.nl/actueel/rechtbank-staat-etnisch-profileren-toe/" target="_blank" rel="noopener noreferrer">include</a> ethnicity, such as in Bamenga’s case “men who walk fast, are well-dressed and who look ‘non-Dutch.’”</p>

			<p>All in all, the ruling of the court means that ethnicity can remain part of the risk and selection profiles of the Royal Netherlands Marechaussee &#8211; a decision that undoubtedly encourages discrimination.</p>
<p>Following the court’s decision, the anti-racism foundation <a href="https://controlealtdelete.nl/" target="_blank" rel="noopener noreferrer">Controle Alt Delete</a> started a petition to denounce the assumption that Dutch nationality is linked to white skin color.</p>
<p>&#8220;In the super-diverse Netherlands in 2021, skin color is not an indication of someone&#8217;s nationality,&#8221; says Controle Alt Delete on its <a href="https://controlealtdelete.nl/" target="_blank" rel="noopener noreferrer">website</a>. In addition to people with a refugee background and people from the former colonies, the Netherlands also has several communities that settled in the country from various parts of the Mediterranean four generations ago.</p>

In fact, however, the Netherlands is known for its multicultural society formed as a result of colonialism and colonialism-related <a href="https://www.aljazeera.com/opinions/2021/9/29/a-court-just-confirmed-to-be-dutch-is-to-be-white" target="_blank" rel="noopener noreferrer">migration</a>. There are people here from all over the world that makes it hard, if not nearly impossible, to define “Dutchness” and associate it simply with skin color.</p>

			<p>The postcolonial migration flows to the Netherlands from the Dutch East Indies, the Dutch Antilles, and Suriname, the labor migration from <a href="https://politicstoday.org/?s=Turkey+" target="_blank" rel="noopener noreferrer">Turkey</a> and North African countries, the arrival of refugees from Bosnia and the MENA region make it impossible to define Dutch identity with racial features.</p>
<p>Immigrants nowadays growingly fall victim to acts of over-scrutiny, discrimination, or hate crimes. According to a<a href="https://bureaubeke.nl/publicaties/ervaringen-en-meningen-van-burgers-met-de-politie-nulmeting/" target="_blank" rel="noopener noreferrer"> report</a> published in 2020 by Bureau Beke, an independent agency that specializes in research and advice in the field of security issues and crime, only in Amsterdam, more than half of the residents have experienced ethnic profiling during contact with the police.</p>
<p>According to the report, significant differences occur between two subgroups. On the one hand, there are the citizens with a Dutch or Western migration background, and on the other, the citizens with a non-Western migration background. The second group gives a lower rating for the general way of being addressed by the police and their trust in police officers. According to the <a href="https://bureaubeke.nl/wp-content/uploads/2020/02/Straatgesprekken_eindrapportage_13-02-2020.pdf" target="_blank" rel="noopener noreferrer">report</a>, citizens with a non-Western background are significantly more likely to indicate they have had contact with the Amsterdam police up to 10 times within a period of six months.</p>

			<p><span class="r-es-drop-cap">W</span>hen focusing on this “police contact” it appears that mostly citizens with a Dutch background are offered an explanation as to why the police stopped or checked them while such an explanation is less likely to be offered to citizens with a non-Western migration background.</p>
<p>The situation in <a href="https://politicstoday.org/?s=Germany+" target="_blank" rel="noopener noreferrer">Germany</a> is no different. According to an<a href="https://www.dw.com/tr/almanyada-3-milyon-keyfi-kimlik-kontrolü/a-19175959" target="_blank" rel="noopener noreferrer"> answer</a> from the Ministry of Interior in response to a parliamentary question by a German representative, the German police conducted ID checks 2,953,844 times without valid reason in 2015. Critics argue that most of these controls are arbitrary and skin color and ethnic background are the two main criteria behind them.</p>
<p>In addition, a survey was conducted by the European Union Agency for Fundamental Rights (FRA) on the number of people who have been stopped by the police in the last 12 months. <a href="https://dergipark.org.tr/tr/download/article-file/2003428" target="_blank" rel="noopener noreferrer">According</a> to responses, 25% of Turkish-origin Europeans had been stopped by the police, while only 11% of so-called native Germans responded positively.</p>
<p>Third-generation Turkish immigrants, born and raised in the Netherlands, also face racial profiling as it frequently occurs within their minority communities as well. It seems that Western European countries, where once multicultural society was a debated issue, are now struggling with “us” vs. “them” ideology.</p>
<p>By constantly keeping the criminality of “foreigners” or young citizens with an immigration background on the political agenda and in the media, and therefore in the public eye, the Other, the “non-Dutch looking” Other, is created and perceived as a threat. Institutions and authorities, with the police at the forefront of this discrimination, are motivated to believe that it is legitimate to monitor, scrutinize, and control people based on their religious difference, appearance, or skin color in order to protect “national security.” However, ironically and conversely, they are actually fabricating this imagined threat themselves.</p>

			<p><span class="r-es-drop-cap">O</span>n Tuesday, the European Court of Human Rights (ECHR) ruled on the arrest and pre-trial detention of the HDP’s former co-leader, <a href="/tag/selahattin-demirtas" target="_blank" rel="noopener noreferrer">Selahattin Demirtas</a>. According to the <a href="https://hudoc.echr.coe.int/app/conversion/pdf/?library=ECHR&amp;id=003-6255331-8141045&amp;filename=Judgment+Selahattin+Demirtas+v.+Turkey+%28no.+2%29+-+several+violations+of+the+Convention.pdf">verdict</a>, the ECHR ruled that Turkey violated the “right to be brought promptly before a judge,” the “right to free elections,” and “limitation on use of restrictions on rights” while the Court also ruled that “Demirtas had been arrested and detained on “reasonable suspicion” of having committed a criminal offence.”</p>
<p>Demirtas’s parliamentary immunity was <a href="https://www.dailysabah.com/politics/2018/11/20/ecthr-rules-for-termination-of-pre-trial-detention-of-demirtas">lifted</a> based on the general vote in Turkey’s National Assembly with regard to the lifting of parliamentary immunities on May 20, 2016. Demirtas had already been sentenced for carrying out terrorist propaganda in 2013 and again was detained on 4 November 2016 with new charges and was finally sentenced last September. Nevertheless, he is also facing much heavier charges for his alleged role in the PKK-backed violent riots on October 6-7, 2014.</p>

<p>On top of a number of speeches given by Demirtas, he also <a href="https://image.yenisafak.com/resim/imagecrop/2018/10/06/10/46/resized_e01f4-a2794bdbhh.jpg">call</a>ed his party to join the riots. 50 people <a href="https://www.yenisafak.com/gundem/selahattin-demirtasin-kanli-tarihi-6-7-ekim-3400345">lost</a> their lives in the riots including 43 civilians, 2 police officers, and 5 PKK members. The most dramatic scene of the events was the death of four friends in Diyarbakir on October 7, 2014. They were part of a humanitarian organization and were conducting charity work, when they were spotted by the PKK-backed rioters. Among the friends, 16-year-old Yasin Boru’s death was the most brutal one. After three of his friends were shot dead (one could run away despite his injuries), Boru was beaten, stabbed, thrown from the roof, and then burnt to death. And all this time, the HDP and its co-leader Demirtas were accusing Turkey for using Daesh as “hitmen” and calling people to join the “resistance.” (Resistance is almost a code for <a href="/tag/hdp" target="_blank" rel="noopener noreferrer">HDP</a> elites in glorifying the PKK’s armed campaign. This was also the keyword when HDP made calls for an urban warfare campaign in the summer of 2015).</p>

			<p>Demirtas later made a public statement in Diyarbakir three days after the murder of Boru and his three friends. In his speech he stated, “We made the call for people to join the protests (riot)” but argued that there was no violence, for which he actually did not use the word riot but “the glorious public resistance.” This speech in which Demirtas blamed the government for the use of violence also took its place within the indictment against Demirtas in his trial in Turkey.</p>
<p>I’m not sure whether the ECHR paid attention to this and alike speeches in the indictments in Turkey, but the ECHR verdict also held that Demirtas “could be said to have been arrested and detained on “reasonable suspicion” of having committed a criminal offence and that there had therefore been no violation of Article 5 § 1 of the Convention.” Nevertheless, the Court ruled that Turkey had violated the right to be brought promptly before a judge, the limitation on restricting a person’s rights, and the right to free elections.</p>
<p>After the decision came out on Tuesday, there was a harsh debate as to whether Turkey will release Demirtas or not. I’m not an expert in law, but here is the decision: The Court held that the respondent State was to ensure that Mr. Demirtaş’s pre-trial detention was ended at the earliest possible date, unless new grounds or evidence justifying his continued detention were put forward; and that Turkey was to pay the applicant 10,000 euros (EUR) in respect of non-pecuniary damage and EUR 15,000.</p>

<p>In response to the voices raised within the EU in regards to the ECHR&#8217;s ruling on Demirtas, Turkish Foreign Minister Mevlut Cavusoglu stated: &#8220;Why are you so silent when it comes to Greece&#8217;s non-compliance?&#8221;</p>

<p>The Court’s most concrete decision is about compensation, but I’m not sure about Turkey’s response with regards to the payment. After all, President Erdogan stated that the ruling is not binding. Further, Turkey’s Foreign Minister Mevlut Cavusoglu <a href="http://www.hurriyetdailynews.com/search/%C3%87avu%C5%9Fo%C4%9Flu">criticized</a> the decision and the statements that the EU’s High Representative for Foreign Affairs and Security Policy and Vice-President of the EU Commission, Federica Mogherini, made on Turkey. In his response, Cavusoglu was on the same line with President Erdogan’s earlier comments and responded to Mogherini by saying, “Why are you so silent when it comes to Greece’s non-compliance?” In a nutshell therefore, it seems that there are no signs for the immediate release of Demirtas.</p>

<h2><strong>Could you give some information about the European Court of Justice, which has taken the headscarf decision? What is its structure and task?</strong></h2>
<p>The European Court of Justice (ECJ) is the highest court in the European Union (EU). It is a three-tiered organization that consists of the Court of Justice, the General Court and courts of expertise. The main objective of the Court of Justice is to ensure the uniformity of the interpretation and implementation of the European Union law. The Court performs the functions of ensuring legal adherence to the interpretation and application of the Union law; harmonization of the national legal orders with the EU legal order; legal administration; commentary; conflict resolution; and legislation. The Court is also authorized to rule a few cases arising from the EU law. These are cases about lawsuits examining the member states and EU institutions’ compliance with the Union law; and interpretation of the EU law when it is necessary for the settlement of the cases in the national courts. The Court consists of one judge from each member state, the General Court consists of 28 judges, which comprises at least one judge from each member state. Judges hold office for a renewable term of six years with the consensus of the member state governments. The independence of the Judges of the Court is ensured by various provisions that regulate the status of the judges. The EU Court of Justice is seated in Luxembourg.</p>
<h2><strong>Is there a relationship between the European Court of Justice and the European Court of Human Rights in terms of their duties and decisions?</strong></h2>
<p>First of all, it must be noted that the Court of Justice is not a human rights court and it should not be confused with the European Court of Human Rights (ECHR). The ECHR is the international Court of courts established by the European Convention of Human Rights of which Turkey is a member whereas the ECHR is not a member of the EU. The Court, as mentioned above, is the highest court of the EU and its duty is not to safeguard human rights, but the interpretation and implementation of the EU law. For this reason, it should be mentioned that the decision that we will discuss was not a lawsuit directly related to and aiming to reverse a human rights violation, but it was related to the violation of the EU legislation that directly affects the right to freedom of religion. Therefore, we may argue that similar cases on this subject are likely to go to the ECHR in the future.</p>
<p>Earlier rulings on the banning of the headscarf by the ECHR were based on the reasoning that it could be prohibited for reasons, for example, when it is considered “a threat to public order”. However, we can say that recent political developments and the current political climate which has influenced the Court’s leanings on this issue are also valid for the ECHR, and that negative decisions giving way to the prohibition are likely to arise as a consequence of this disposition.</p>
<h2><strong>Can you summarize the controversial headscarf decision of the European Court of Justice? What is the content of the case? How did it come to this stage? What is the grounds for the decision of the court?</strong></h2>
<p>The complaint regarding the headscarf ruling was initially made by a Muslim woman named Samira Achbita, who resides in Belgium. Since 2003, Achbita had been working for the security firm G4S as a receptionist. She had been there for three years when she informed her employee that she would begin wearing the headscarf. Her employer has rejected the request by reasoning that wearing signs that symbolize and visualize political, philosophical, or religious views would be contrary to the principle of neutrality towards customers, and this is among the internal, unwritten rules of the company. Despite this ruling, Achbita informed her workplace that she intended to­ wear her headscarf to work. On the day following Achbita’s decision, a written prohibition on religious and philosophical symbols in the work place was added to the employee code of conduct. Achbita insisted on wearing her headscarf and consequently was dismissed from her position as she was acting in violation of the workplace regulation.</p>
<p>Samira Achbita initially filed a lawsuit in the Belgian courts, which reached the Belgian Court of Appeals. The Belgian Court of Cassation then applied to the European Court of Justice to see whether the ban on headscarves at work is in line with the EU&#8217;s 2000 Directive on equal treatment in employment and occupation. The case file and the dispute came before the Court. In other words, the Court review was not in regards of whether the prohibition was a violation of human rights and freedom of religion, but rather if it was in compliance with the EU Directive on equal treatment.</p>

			<p>The Court ruled that the G4S security firm implemented a regulation of the workplace that did not discriminate based on religion or belief and that there was evidence to suggest that no specific discrimination was directed towards the person who filed the case and therefore it could not be ruled as a discrimination case under the EU Directive. In this particular case it was argued that there was no discrimination against a specific religion or worldview within the regulation which warranted an “indirect discrimination” case. In addition, it has been noted that it is legitimate for an employer to seek the protection of political, religious, and philosophical neutrality towards their employees and clients. It is emphasized that this rule is of particular importance for people who are in direct contact with customers.</p>
<p>As a result, the Court ruled that the prohibition of the wearing of visible signs of political, philosophical or religious beliefs by companies would not constitute discrimination and the prohibition with the aim of “dress neutrality” was not contrary to the EU Directive regarding the direct and indirect. Finally, the Court abstained from making a decision in a similar case in which a woman in France was also dismissed from her workplace, because in that particular case, the dismissal was due to a complaint of a customer.</p>
<h2><strong>What is your view on the basis of the religious symbols and the justifications of neutrality that the decision is based on?</strong></h2>
<p>First of all, this decision is based on the claim that the prohibition was not targeted towards a certain religious or belief group and was a general rearrangement. In the justification of the decision, there were the employer&#8217;s defense and general expressions such as religious, political and philosophical symbols. However, it is commonly known that this specifically targets Muslim women and affects those that wear the headscarf and that they are the target of these decisions. As a matter of fact, it’s not all people who wear religious symbols that are affected by this decision but mostly those who are of the Muslim faith. The decision disregards the fact that headscarf was wore with the belief that it is a mandatory requirement of Islam. Furthermore headscarf is regarded as an instrument people use to reflect their faith.</p>
<p>Additionally, the Court ruling regards not wearing a headscarf as “normal/essential/actual”, implies that wearing a head covering is not and that represents impartiality. Thus, the court acted with the prejudice that wearing a headscarf symbolizes a religious affiliation and automatically is contrary to any type of neutrality. This recalls the headscarf discussion that takes place in Turkey time to time, in which the headscarf has been a contested symbol in the public workplace and that this symbol gives the impression that they are in opposition to those they serve.</p>
<p>It must be mentioned here that the headscarf decision is not based solely on legal grounds but has been influenced by the rising overall political atmosphere in Europe. The increased influence of the far right, the Islamophobic and anti-Turkish parties and politicians did not only affect other politicians and governments but also took hold of all of Europe’s institutions as well as its judiciary. This is a political decision that has technical legal aspects.</p>
<h2><strong>What are the consequences for European Muslims and Turks in the future?</strong></h2>
<p>As I mentioned previously, this decision is not a unique one but a part of politics that began to dominate Europe in a number of areas. Indeed, the Vienna based European Union Agency for Fundamental Rights (FRA), welcomed the Court&#8217;s decision by stating that it was in line with the principles of equal treatment. It certainly would not be at all surprising if we see similar decisions made by various different courts and institutions and that this practice becomes widespread across Europe. We see the statements from different countries supporting the decision. Needless to say, contrary to values such as multiculturalism, human rights, and democracy that Europe has demanded for years and is still demanding from candidate countries such as Turkey, it is very likely that Islamophobia and anti-Turkish sentiment will continue in Europe and make living conditions for Muslims much more difficult.</p>
