It does not matter if a group won the country’s independence through arms or through dialogue - what matters at the end of the day is meeting people’s increasing needs.

Liberation legitimacy occurs when a group that is fighting a liberation war in the context of foreign domination enjoys the feeling of the support of the masses and attains international legitimacy to fight the war. This feeling of being legitimate often remains as the only force on the ground in the context of foreign domination, occupation, or colonization.

Liberation legitimacy derives its validity from the self-perception of non-state actors fighting a liberation war, the continuation of the foreign occupation, and the relevant international laws that provide that people under occupation have the right to self-determination. This argument, from the point of view of non-state actors and international law, appears to conform to the existence of occupying foreign forces occupying another nation. But the question is, what happens if these forces leave?

In some examples, non-state actors have engaged in civil wars as a result of the emergence of other forces that adopted different views on how to deal with the foreign presence on their soil. This includes Algeria, Palestine, Angola, Lebanon, Afghanistan, and Vietnam, among others. A major justification for the use of force by dominant non-state actors is the legacy of fighting foreign forces which very often provides them with a valid legitimacy. This legitimacy ends when the presence of foreign forces ceases; however, some self-described liberation groups behave as if it lasts even after the foreign forces have left.

Some liberation movements (non-state actors) in many parts of the world, be it in Algeria, Zimbabwe, Mali, and Ghana, have (mis)used liberation legitimacy even after the foreign occupation ended. This has created a dilemma for these self-described liberation groups as in the transition to democracy many of them have leaned on their entitlement to rule which derives from what they view as their liberation legacy. Some non-state actors, such as the Palestine Liberation Organization (PLO) in Palestine and the National Liberation Front (NLF) in Algeria, act as if this legitimacy is stronger than electoral boxes.

Voters, who might be the same base that gave support to liberation groups during wars of independence, might vote for another group or individuals who didn’t emerge out of liberation groups. In many instances such as the NLF in Algeria, voting a liberation group out of government results in the army’s opposition to such unfavorable electoral results and its intervention which impacts the country for years to come. In other cases, the leaders of the liberation war stay in power indefinitely, claiming a liberation legitimacy and legacy.

An example of a leader who stayed in power by utilizing liberation legitimacy is Robert Mugabe of Zimbabwe, the leader of the liberation war, who stayed in power for 30 years despite becoming very ill towards the end of his life. Although Mugabe adopted reforms that defended the rights of his people to better access to education, healthcare, and land, his last years in power saw the deterioration of his country’s economy to record levels. Claiming his right to rule as a result of fighting a liberation war, he even appointed his wife as his deputy. Mugabe was forced out only after the army intervened and pressured him to resign in 2017.

Although there are examples where liberation groups cling to power claiming their liberation legitimacy and legacy, there are other examples where liberation groups establish democratically elected governments. A well-known example is the government of South Africa, which despite accusations of corruption, still runs as a functioning democracy. It was the struggle of the African National Congress (ANC) that led South Africa to end the rule of a white minority and state apartheid.

This culminated in the election of Nelson Mandela as the first black president of the country in 1994. Today, however, the government of South Africa faces mounting challenges and a legitimacy crisis due to accusations of mismanagement and corruption.

Sinn Féin’s transition to governance has also created divisions among the Irish people with some viewing the Good Friday Agreement of 1998 as a positive step and others as a setback.

Another example where national liberation groups have succeeded in moving to governance is Sinn Féin in North Ireland, where the political group is now part of the country’s political system. The transition of Sinn Féin to governance and its acceptance of a political settlement came at a high cost as it followed a wave of violence for attaining independence from Britain. Sinn Féin’s transition to governance has also created divisions among the Irish people with some viewing the Good Friday Agreement of 1998 as a positive step and others as a setback.

In many cases, liberation movements fail at government because they lack the understanding of the dynamics of governance which are different than waging a liberation war and taking arms. Fighters waging a liberation war tend to have a different understanding and working mechanisms than those involved in government.

Viewing decision-making in absolute terms does not help people on the ground. For this reason, many liberation groups, whose expertise is limited to armed struggle, fail to present solutions to the struggles of people on the ground.

The claim to liberation legitimacy creates a dilemma for liberation groups in government; they sometimes act against the will of their people although they were meant to exist to defend this very same will. Liberation groups need to establish bodies and mechanisms that can ensure a smooth transition to providing good governance after the end of liberation wars.

Once a liberation war is over, it is the electoral box that gives a government its legitimacy. Once liberation groups refrain from respecting the will of the people under the claim of enjoying an absolute liberation legacy, they lose the people’s respect.

The last phase of liberation should always be moving to good and democratic governance. Nelson Mandela, the charismatic leader of South Africa, has set a good example by running for president only once. Refusing to let go of power based on claims of liberation legacy does not sell. What sells for the ordinary people on the ground is providing them with solutions to their problems especially in a post-liberation phase, where transition to government faces many structural challenges.

It does not matter if a group won the country’s independence through arms or through dialogue – what matters at the end of the day is meeting people’s increasing needs. It is up to liberation groups to present people with leaders who can win elections. Once a group is unable to do so, by no means should it use its liberation legacy as an excuse to continue being in power in opposition to the will of the nation’s people.

Statements made by politicians and similar moves in order to gain potential votes from far-right, anti-Islamic and populist circles just polarize the country while excluding Muslims in Germany.

In addition, his party, the CSU’s Bavarian leader Markus Söder recently announced that crosses must be hung in all Bavarian state’s government buildings, stating that the move is a “commitment to Bavarian identity and culture.” Besides the fact that his first act as the new leader of the Bavarian government is most probably violating the constitution’s neutrality, and on the other hand, most of the four million Muslims in Germany would actually have no problem with Söder’s act of emphasizing Christianity, there are also some other statements by politicians which are also quite disputable.

For instance, a leading federal politician from Chancellor Merkel’s ruling CDU party, Volker Kauder, made a speech on 27 April about the freedom of religion at Germany’s federal parliament, the Bundestag. Kauder said something very strange which has to be addressed in detail. In his speech Kauder used these words: “As we –of course– give Muslims the possibility –and we are supporting this– to build their mosque and to worship in it, as part of freedom of religion; we demand that the Christians can also build their small churches in Turkey, my dear ladies and gentlemen.”

Before addressing this statement, it has to be mentioned that Kauder is heading the strongest parliamentary group in the German Bundestagand his party CDU is a member of the coalition government ruling the country. Generally, people would thus expect that a high-profile and influential politician from such a central party in one of the wealthiest countries in the world prefer legitimate and reasonable words. However, this did not happen. Let me explain why.

Kauder’s statement is very problematic from some basic points.

First, he said that “we give Muslims the opportunity…” But, whom does he mean with “we” in a country that respects the rule of law and whose constitution expects religious neutrality? If he explicitly names some people as “we,” he consequently excludes others. Does he mean “we” Germany and all its people as a whole? Or, just ethnic Germans who are Christians? Or, also Germans who are Germans due to their German citizenship? Or, just Christians independent of their nationality or ethnic origin, or, just the CDU or CSU?

Furthermore, Kauder stressed that they (“we”) give “Muslims” the possibility to build mosques in Germany. But who are these “Muslims?” And do they have a special status according to the German constitution or do they need special treatment? Does Article 4 of the German constitution (freedom of faith, conscience, and creed) not protect Muslim rights as much as it does Christian rights? Do Muslims need a tolerance range due to a constitutional lack? Or, does Kauder just mean the (approximately 3 million) Turkish Muslim population who are living in Germany or the 1 million Syrian refugees or even other German Muslim groups with a background from Morocco, Lebanon, Bosnia, Iran, Iraq etc. Or, Muslims who are actually ethnic Germans?

It’s also very absurd and not acceptable from a democratic point of view as to why Kauder requests something in the form of a precondition and response to freedom of religion in Germany. Does Germany’s constitution allow people who are not Christians or Germans to practice their religions only if the country of their origin, where they or their parents once upon a time came from, deliver the same rights? For instance, in the form of allowing to build churches and to worship in them? In the context of Turkey, his arguments are not true because churches do exist in Turkey along with Christian groups and communities. However, the question arises whether Kauder would go so far to prohibit building mosques in Germany if Muslim-dominated countries would do the same against Christians? If yes, how will he legitimize this kind of antidemocratic and unconstitutional request? As predicted, this kind of a premise has nothing to do with democratic mentality.

Thus, it must be stated that Muslims in Germany, who possess German citizenship or not, have also one of the indisputable basic rights, the freedom of religion, according to which the “undisturbed practice of religion” is guaranteed in Germany – without any precondition. Unfortunately, statements made by politicians and similar moves in order to gain potential votes from far-right, anti-Islamic and populist circles just polarize the country while excluding Muslims in Germany. Mr. Kauder can of course stand up for the demands of Christians building churches all over the world. However, he does not have the right to instrumentalize Muslims living in Germany who are under the protection of the German constitution.

The question has to be asked again: What does Germany stand for? Freedom and liberalism or populism? Is this the Germany, which is being dreamt of and which is being constructed for the future? Are universal values being sacrificed for short-term political scores and gains?

German politicians lately announced that they will debate and probably introduce a headscarf ban for girls under the age of 14 in North Rhine Westphalia (NRW). Announced by the NRW Integration Minister, Joachim Stamp, the initiative for such a ban gained both support and objection.

Right populism has increasingly dominated German politics. Since the foundation and particularly since the success of the right-wing Alternative für Deutschland (AfD) in the September 2017 general election, this populist discourse has literally boomed. Although AfD is the youngest political party in Germany, found in 2013, it is arguably one of the most influential actors with its political figures and rhetoric regarding setting the political agenda in the country. So, consequently, we are witnessing how the rest of Germany’s political atmosphere and discourse are shifting to this level and how it is becoming wholly absorbed the right-wing populist rhetoric.

As if it’s not enough that Muslims are criminalized and discriminated in Germany on a daily basis both politically and socially because of their religious identity, the basic human rights of freedom of religion and the right to free practice of religion are literally trampled on within the headscarf debate. The silence while mosques are continuing to be burnt down in Germany, the headscarf ban for Muslim teachers, and the endless debate as to whether Islam belongs to Germany or not are just a couple of events that have been unacceptable so far. With the headscarf ban on pupils however, Germany brings a new of level of hypocrisy, which will inevitably lead to a new level of polarization. Of course, any defender of this ban will try to justify the situation as compatible with the legal order or so-called accepted by society.

One of the defenders of this unconstitutional initiative, Serap Guler (CDU), the undersecretary in the integration ministry of NRW, stated that the headscarf “is what sexualizes the child,” but then added, “when a young woman then says: ‘I want to wear a headscarf,’ that is her right, which we also accept and respect.” Firstly, people may ask, where is the acceptance and respect you seem to offer? Secondly, how many young girls has Mrs. Guler encountered until now who were supposedly forced to wear a headscarf at day-care or elementary school? Thirdly, do the governing people of Germany intend to ban everything they evaluate as wrong or contentious with what is taught to the nation’s children by their own parents? What is the line for that evaluation and estimation? Lastly, what on earth is Germany’s problem with Muslim bodies?

Debates about a headscarf ban, a circumcision ban, a burqa ban and so on… Polemic topics brought to the table from time to time in order to fuel the climate of fear, tension and hate. Pseudo problems that do not exist and evidently solutions that do not help anyone or anything… The fact is, these are all attempts to target Muslim bodies – especially Muslim women bodies – which is an effort of perversion in itself. Politicizing and pointing at other people’s bodies and consequently de-humanizing them is not a rational way of doing politics. On the contrary, it is a sign of the collapse of politics. This type of policy that attempts to discipline and educate Muslim women’s bodies on the one hand and Muslim parenthood on the other reminds us a quote by Foucault’s ‘Discipline and Punish.’ Foucault states that discipline creates individuals as power sees individuals as objects and as instruments. According to Foucault, its purpose is a “permanent economy” for power, which is both modest and suspicious.

Populist politicians in Germany use Muslim bodies as objects and instruments for their political gains. The economy of permanently discrediting Muslims as “problematic” humans who have to be changed in order to be appropriate citizens is being kept alive permanently. Populists also use discriminatory sentiments in grassroots as a capital to strengthen their persistence.

Long before these discussions, the debate as to whether Germany lost her title as the advocate for freedom and liberal values had emerged. Although the headscarf and modest clothing are both part of a Muslim woman’s identity and as part of her Islamic personality, the whole discussion has always been kept on a political and symbolic level – not by Muslims but by both politicians and society. Pushing minority practices under bans and restrictions is treacherous for politics. While the history of Germany shows the result of populism, liberal values, which have been lost to the AfD, are being tossed aside in order to gain political support.

Moreover, there are different and much more important problems that Germany needs to be discussing rather than the headscarf ban. To remind the reader, Germany has still not been able to solve the NSU case and the related serial murders against innocent people with the help of state agents, which shows us that German politicians and the public opinion are vesting their energy on a wrong debate. Another serious problem is for instance, the lack of freedom, especially for the Muslim population. Apart from these, Germany has a real social and tangible problem that we also have to point out. According to Saarbrücker Zeitung, 4.9 million people in the country barely have a proper meal every other day. More, figures indicate that 30,000 migrants are currently missing in Germany and that out of these, 9,000 are children. This is nothing but catastrophic.

So why is it that politicians carry a minor issue like the headscarf to the center of politics, but do not solve real and tangible social problems? Center parties such as the CDU in Germany have become sympathetic to marginal initiatives. The country currently needs concrete solutions for both anti-Semitist and anti-Muslim sentiments without being selective between different discriminative incidents.

Nevertheless, the headscarf is neither a political symbol nor an accessory. However, this debate is indeed symbolic and target oriented. The main problem is not supposedly the half dozen young girls who wear a headscarf because of very naïve and simple reasons such as pure curiosity etc. The intention here is to normalize and accustom society to similar restrictions and bans. Thus, the next step following this would initially be a headscarf ban for all Muslim women in public. When this becomes the case, there will be no voice of disapproval or even outrage since these pseudo debates suppress people deeply, leading them to internalize discrimination or polarization so that limits against the freedom of others becomes an everyday and ordinary issue.

The nightmare scenario for Germany after the 2017 election was that AfD, with its populist, racist and fascist attitude, could have become a coalition partner in a minority government. It is currently the third biggest political party now. Nonetheless, we are currently witnessing a political leadership in Germany that could potentially replace the AfD in its polarizing politics. This right question has to be asked again: What does Germany stand for? Freedom and liberalism or populism? Is this the Germany, which is being dreamt of and which is being constructed for the future? Are universal values being sacrificed for short-term political scores and gains?

The fact is that Germany has to save herself from being stuck within this populist atmosphere and has to enhance cultural pluralism with all its institutions and instruments. Otherwise, a dangerous social polarization will be inevitable.
